Boy hit in drunken rage
A 35-YEAR-OLD man has escaped jail time for an incident where he punched a six-year-old boy in the face.
The man pleaded guilty to to contravening a domestic violence order and contravening a police direction in Proserpine Magistrates Court on Monday.
Police prosecutor Senior Sergeant Matt Saunders said police attended a Cannonvale address around 10pm on July 2 and found the man shouting, smelling of liquor and slurring his speech.
He shouted at police saying "what the f*** are you doing in my house?".
Sgt Saunders said he was given numerous chances to to provide his name and address but he refused.
The court heard the mother of the child had gone out to dinner and left the man in charge of the kids.
She returned around 9.30pm that night and when she went to check on her son, she found bruising on his face. The man got angry and started screaming at her.
The child later told police that "dad hit [him] in the eye".
Defence solicitor Raymond Taylor said the man was intoxicated at the time and had a lack of recollection of what happened and had doubts about whether the marks were caused by him.
"He does concede he has a problem with alcohol," Mr Taylor said.
Magistrate Simon Young said there were no excuses.
"It is a cowardly act to hit a young child. The reason is immaterial," he said.
"This type of action must be condemned. Attacks on children will not be tolerated."
For domestic violence, he was sentenced to three months imprisonment, wholly suspended for two years and a conviction was recorded. He was convicted and not further punished for contravening police and had no conviction recorded.
