Card table tiff ends in court a decade later

A MAN has been found not guilty of a violent assault against another man, 10 years after the event.

Hervey Bay's Tony James Wilson, 60, faced the Hervey Bay District Court charged with assault occasioning bodily harm against Mervyn Poschalk on November 13, 2003.

In front of a jury, several witnesses gave testimony about the events of that evening, starting with Mr Poschalk.

The court heard Mr Poschalk had driven to Mr Wilson's house with his partner, Virginia Mumford, to collect some card tables that had been removed from her home.

The two needed the tables for Ms Mumford's 40th birthday celebrations, the court heard.

The tables were inside Mr Wilson's carport.

Mr Poschalk said he asked Mr Wilson for the tables back and the two had started to put the tables in the back of his car.

But on their trip to grab the final table, Mr Wilson had turned violent, Mr Poschalk claimed, landing several punches on his face, back, neck and shoulders.

In cross examination, Mr Poschalk was asked if he had caused the altercation and whether he had driven his car at Mr Wilson when leaving the property, which he denied.

The court was shown several images of Mr Poschalk's injuries from that night.

Ms Mumford also testified as to the events of the evening, saying she had not seen what happened inside the carport but that she had heard Mr Poschalk yelling for help while she waited in the car.

In response, Mary Gala testified she had been inside Mr Wilson's home watching a movie with him and another man when an irate Mr Poschalk knocked on the door, demanding the tables.

Mr Wilson had told Mr Poschalk to take the tables and went to the carport to help him, Ms Gala testified.

She then saw Mr Poschalk push Mr Wilson, who in turn pushed him back.

Mr Poschalk then punched Mr Wilson, she told the court, and Mr Wilson had retaliated with several punches of his own.

Ms Gala said she had seen Mr Poschalk drive at Mr Wilson twice while leaving.

Mr Wilson also testified that it was Mr Poschalk who started the altercation.

He was found not guilty.
