Driver caught on a drug cocktail

TAKING a few drugs and having a couple of drinks at a music festival and then getting behind the wheel has cost one Whitsunday man $3000 and an 18-month licence suspension.

Mitchell Bruce Wakely told Monday's sitting of the Proserpine Magistrate's Court he had been to the Happy Daze Festival and was driving back to some friends in Airlie Beach when he was pulled over by police.

It was around 10.15pm on May 28 when police stopped him after receiving reports that a car was driving slowly and swerving into lanes on the Bruce Hwy at Proserpine.

Police prosecutor Tyler Roberts told the court the car was "travelling at slow speeds, weaving, and constantly crossing the white lines".

When asked by police if he'd consumed anything in the last 12 hours he said he'd taken MDMA.

Police said he had slurred speech, bloodshot eyes and appeared to be propping himself up by leaning on the car.

He was then even more honest with police and said he'd taken a tab of acid, a tablet of MDMA and a quarter of a bottle of vodka.

His blood alcohol reading was 0.05% and tests showed he had MDMA and MDA in his system.

Magistrate Ron Muirhead said jail time was an option.

"Someone could have been killed due to your stupidity," he said.

"A prison term would not be out of order.

"Driving on the highway, heavily affected by drugs is extremely dangerous - it could have led to a fatal accident."

Wakely, who was representing himself, was mostly silent in court but did say it was "obviously very stupid and I'm regretful".

In handing down his sentence, Mr Muirhead said he would avoid imposing jail time due to Wakely's age, employment and lack of criminal record.

"Your alcohol (reading) wasn't that high, but obviously you were affected by drugs," he said.

"You were driving slow but you were still a danger to other road users."
