Drugs land a man two years
ONE man's inability to stay off drugs has cost him a second large stint on probation.
Kenneth John Mackay faced Proserpine Magistrate's Court on Monday charged with drug possession and carrying a drug utensil.
Mackay's defence got off to a rocky start as he refused to see a duty lawyer, despite being advised to do so by police prosecutor Kevin Carmont.
Magistrate Simon Young was not impressed with Mackay's decision to refuse legal assistance and represent himself and his apparent lack of concern for the seriousness of the charge.
"Possessing cannabis for personal use carries a maximum of 15 years imprisonment," Mr Young warned.
The court heard that on June 16, police went to Mackay's home.
He was honest with police and declared he had drugs on the property.
Police found two bongs, a container with cannabis in it and several pipes.
In his defence Mackay said he was not harming anyone else with his personal drug use.
"I don't carry drugs on the street, I do it for anxiety," he said.
"I want to set myself up to be a productive member of society."
Mr Young was thoughtful.
"You have left me in a very difficult position Mr Mackay," he said.
The court heard that Mackay had previously been on two and-a-half years' probation for similar offences, with monthly urine testing which required him to stay under a certain level. On Monday he was sentenced to two years probation, with urine testing also.
