Drunken tirade ends with punch

A DRUNKEN altercation has landed one 17-year-old a $1000 good behaviour bond.

The incident occurred on January 23 around 12.15am outside the Proserpine Cricket Club, where Mitchell Duncan Whitton punched a bus driver.

Charged with common assault and public nuisance, the Proserpine Magistrate's Court heard Whitton had attended a party at the club between 10pm and 12.15am and went to get on the bus with a drink when he was told by the driver he couldn't take alcohol on the bus. He and another person got on the bus anyway. The driver then searched the bus and looked for Whitton, with the help of another lady.

Police prosecutor Tyler Roberts said when the driver tapped him on the shoulder to leave, Whitton directed his anger at the lady and said "you can't f****** touch me you f****** b****. F****** c*** f*** off."

He got off the bus and pushed the woman in the chest and she fell over.

The driver tried to get in between them but he was punched in the chest.

Duty lawyer Cleo Rewald said the altercation stemmed from a previous incident on the night.

"At 11.15pm a woman starting yelling at him accusing him of breaking something. He said he didn't know why she was talking to him," she said.

"It continued for a few minutes.

"He left with a friend, saw a bus, hopped on with the friend and while on the bus, the lady came out and started yelling at him again."

Magistrate Ron Muirhead said "we all know what can happen when someone is punched".

"In the future if you punch someone, and you're charged with assault, you might find a court say 'he hasn't learnt' and enforce a term of imprisonment," he said. "(But it's your) first time in court - hopefully your last time."
