Fine, sentence for obstructing police
OBSTRUCTING police and possessing cannabis landed Bradley John Wilkes in hot water in the Proserpine Magistrates Court on Monday.
The court heard Wilkes was facing charges arising from two separate incidents.
Acting Senior Constable Tyler Roberts said the first occurred at around 12.20am on July 30 when Wilkes and two friends were evicted from Boom Nightclub in Airlie Beach.
The group walked across the road to Beachworx where an argument broke out, requiring police to intervene.
Wilkes' friend was arrested during the ensuing scuffle.
"During the arrest Wilkes became increasingly agitated,” Snr Const Roberts said.
Wilkes moved closer and was pushed away by police.
"This resulted in Wilkes adopting a fighting stance and swinging his arms about in a windmill action,” Snr Const Roberts told the court.
Wilkes was then resisted arrest, with an officer suffering a graze to his throat and losing buttons from his shirt.
Back at the watch house, 1.5g of cannabis was found in Wilkes' shoe.
In relation to the second incident, the court heard Wilkes was intercepted on the Bruce Highway, Colosseum, at around 8.50pm on August 10 and was detained for a search.
Officers found a small plastic container on the rear seat of the car containing 1g of cannabis, which Wilkes described as "a couple of crumbs in a bowl”.
Officers also found a glass water pipe wrapped in a wet towel inside a plastic bag on the front passenger seat with an "odour of burnt cannabis”.
In court on Monday Wilkes said of the first incident that he was worried about his friend.
"All I was trying to do was ask them why they were arresting my mate,” he said.
"I was never trying to cause any trouble or anything.”
Wilkes was fined $800 for the obstruction, while the drug offences each brought a one-month imprisonment term.
This was to be served concurrently, but wholly suspended for six months.
