Fined for not calling it quits

BERNARDUS Doves has experienced a birthday gone bad after refusing to stop partying despite being officially warned by police.

Proserpine Magistrate's Court heard on Monday that Doves had been celebrating his birthday on August 6 when patrolling police saw him being refused entry by security around 10.15pm at Paddy's Shenanigans.

After being refused entry, Doves started swearing at security staff.

Police prosecutor Acting Senior Constable Tyler Roberts said police then intervened and Doves started swearing at them stating that "it was his birthday so he should be allowed to do whatever he wants".

Police transported Doves to Club Crocodile Hotel in Cannonvale where he was staying and issued him a move on direction to not return to Airlie Beach that night.

However at 11pm, police were standing outside Magnums Hotel when they saw him walk past and try to gain entry.

Police asked him why he was back in town but he refused to stop.

Doves had to be physically stopped in front of Airlie Beach McDonalds and began calling police derogatory names "in front of the public".

He told police that it was his birthday and that he had "a big day with my friends".

"I was a bit intoxicated," he said.

Representing himself, Doves stuck to the same story he told police on the night in question when told to explain himself in court.

"It was my birthday," he said.

In handing down his sentence, magistrate Simon Young said "the maximum penalty for this offence is over $7000 but it seems to me that nothing like that amount is sufficient".

He was fined $500.
