Man behind bars after threat to kill
A MAN who allegedly told a police officer he would kill another man has been refused bail.
Peter John Burns was brought to the Proserpine Magistrate's Court in police custody on Monday charged with one count each of fraud, receiving tainted property, improper use of an emergency call service and using a carriage service to make a threat to kill.
Burns was arrested at 5.15pm on Sunday, February 15, after police found another man allegedly selling a stolen outboard motor on his behalf.
Senior Constable Tony Parkinson, of the Whitsunday Police, said Burns had made a complaint about the motor being stolen on January 24.
The Mt Julian resident, who had his arm in a sling at court on Monday, instructed duty lawyer Sherrie Meade to apply for bail.
Police prosecutor Elizabeth Smith said this was opposed due to concerns that Burns was an unacceptable risk of committing further offences and interfering with witnesses, based on statements he had made to police.
Ms Smith said Burns had a "lengthy and protracted history" involving offences of a violent nature and time behind bars and that these latest offences were "significant" by themselves.
Ms Meade argued Burns had just undergone reconstructive surgery to his shoulder and wasn't capable of hurting anyone. She said he was immobile to the point that a carer would be coming to his property to assist with basic needs such as meals and showering.
"The chance of him being able to interfere with anybody or harm anybody is next to impossible," she said.
Ms Meade also argued Burns had behaved the way he did at the police station because he was fearful of going back to prison and angry at the thought of being in contact with someone who could have jeopardised his parole.
Magistrate Haydn Stjernqvist told Burns there were a few issues to consider when it came to whether or not to grant bail.
He said one of these was the fact the 57-year-old was alleged to have told a police officer at the watch house "I'll kill that f***ing little c**t when I get out of here".
Bail was formally refused and Burns was remanded in custody until his next court appearance on March 16, when he will appear via a video-link between the prison and the court.
