Gladstone man convicted after being caught with tackle out

A GLADSTONE man has been placed on probation after being caught masturbating with his pants down behind Pat's Tackleworld.

David Maxwell Forrest, 56, was caught red-handed after a member of the public saw him sitting with his pants around his ankles pleasuring himself behind the local fishing store at 4pm on November 25, 2013.

Police prosecutor Mick O'Rourke told the court the member of the public who reported the incident informed police Forrest had tried to pull his pants up after being sprung, but had appeared too intoxicated to successfully cover himself up.

Forrest denied to police that he was masturbating, but was given an order by police not to enter the Gladstone CBD area between 6am-6pm, after they had dealt with him on November 25.

Forrest was located at Pat's Tackleworld again on December 9, leading to a breach of bail charge, one of three offences Forrest pleaded guilty to in Gladstone Magistrates Court on Tuesday.

Defence solicitor Jun Pepito argued his client was not masturbating, but suffered from bladder issues, meaning he had to pull his pants down to urinate.

"He was drunk; he was trying to pull it out to urinate, not to masturbate," Mr Pepito said.

Forrest was convicted and fined $100 for being drunk in a public place, and was convicted and had his probation order extended for a further 12 months for the breach of bail and wilful exposure offences.
