A MAN who hid from police on the top shelf of a wardrobe will spend the next two months behind bars.

Jasen Paul Allen was brought to the Proserpine Magistrate's Court in police custody on Monday, following his arrest earlier that day.

The court heard that Allen was initially bailed from the Mackay watch house on August 24, with a condition about living at a Mackay address attached.

Police prosecutor Elizabeth Smith said he subsequently moved to commission housing in Jubilee Pocket without notifying police.

Allen was found at the Jubilee Pocket address on October 1, in the company of a woman with whom he was prohibited from having contact.

On October 3, he was named the respondent in a Domestic Violence Order (DVO) made in the Proserpine Magistrate's Court. A mandatory good behaviour condition was attached.

At 2am on Monday morning, police returned to Allen's Jubilee Pocket address after receiving reports of a loud disturbance. Ms Smith said Allen walked out onto the balcony, looked down on police and walked back inside, slamming the sliding door. She said the woman eventually looked out of the bathroom window and police persuaded her to open the door.

Allen, who was found hiding on the top shelf of a wardrobe, was arrested and brought to court, charged with breaching his bail and release conditions, as well as those of the DVO.

Duty lawyer Sherrie Meade argued he had not blatantly tried to go against the orders, blaming other elements such as a "toxic relationship" for the series of events that occurred.

Magistrate Haydn Stjernqvist did not agree, saying this was just "straight out blatantly contemptuous of the orders that were made by courts".

Allen was sentenced to four months imprisonment for each of the offences, of which he will serve two months actual time behind bars. The balance of the sentences will then be suspended for 12 months.
