Man threatens to kill his mum
A 35-YEAR-OLD man will spend the next month in prison after being convicted in the Proserpine Magistrates Court on Monday of eight offences, including a horrific domestic violence incident where he threatened to kill his mother.
The man pleaded guilty to all charges, with the court hearing about a string of events in which the man was involved in the past 12 months, including stealing and drug offences.
Police prosecutor Sergeant Glen Whittle said the first incident happened between November 3 and 5, 2015, when the man checked into the Oasis Inn in Cairns and left without paying.
The man told the hotel that he had been "robbed and his wife was in hospital” and that he would pay on the 5th when he got paid. He then left on the 5th and said he was going to the bank and never returned.
Magistrate Simon Young said the most serious offence occurred on February 19 when the man breached a domestic violence order.
Sgt Whittle said the man sent text messages to both his mother and brother throughout the morning.
The highly offensive messages contained threats including one to his mother that said "I'm going to send someone to kill you” and "stay away from my kids you pathetic excuse of a mother”.
To his brother he also said "you're a lowlife scum dog” and "stay away from my kids you pedo f***”.
Pleading guilty to the offence, it also meant the man breached a standing probation order.
Then on June 10 about midnight the man was pulled over by patrolling police in Jubilee Pocket and found to have small amounts of cannabis and methylamphetamine, electronic scales and a glass pipe in his possession.
He also failed to appear in Sarina Magistrates Court on the same date, which resulted in a failure to appear charge.
On August 25 the man stole a purse from Proserpine's Prince of Wales hotel.
Sgt Whittle said the man was able to be identified from CCTV footage and that later that day a local resident found the purse and handed it in. The lady who owned the purse said there was $600 missing.
On September 22 the man also stole some beef jerky from Fausts IGA after opening the packet and shoving it down his shorts.
Duty lawyer Cleo Rewald said most of the incidents were related to the man's drug problem which began after losing his father and the end of a relationship.
"It was a period of time when he was not stable mentally, he was very transient and was homeless for a period,” she said.
In sentencing, Mr Young said the text messages were "particularly vile, but there's no evidence of follow through”.
"The offending reflects someone transient, evidently affected by drugs and unable to appropriately control his own behaviours,” he said.
The man was sentenced to three months jail for the domestic violence breach and re-sentenced for his probation offence with a parole release date of December 7. He was also fined $1000 and ordered to pay restitution of $600 to the purse owner, $290 to the hotel and $7.96 to IGA.
