No case to answer: Whitney walks clear from investigation
WHITSUNDAY mayor Jennifer Whitney has been cleared of allegations made to the Crime and Corruption Commission that she acted improperly over the sale of land at Waterson Way.
The mayor was referred to the commission last year by Airlie Beach resident Dr Roger Down who had concerns about procedures relating to the proposed Chinatown site.
Cr Whitney always claimed her actions around the sale - limited at best due to a "perceived" conflict of interest - were above board.
Last week she received confirmation of that.
CR WHITNEY was given the good news by Whitsunday Regional Council's CEO Barry Omundson who conveyed the contents of a letter from the CCC.
"He's been liaising with the CCC regarding concerns raised with the 'perceived' conflicts of interest in relation to Chinese developers and in particular the sale of council land at 45-71 Waterson Way," she explained. "He informed me the CCC's finalised its assessment of all of these matters and they've determined to take no further action.
"They've noted the reasons for my 'conflicts' and that some of them were recorded incorrectly in our minutes.
"We're (now) going to be paying more notice that if I do step out of the room it is recorded correctly."
As for allegations she had improperly used her position to favour developers or benefit herself, "The CCC do not consider it reasonably raises a suspicion," Cr Whitney said, adding she had been unfairly reported "left, right and centre about anything and everything".
"I've never had a material personal conflict of interest - I've always put it in as perceived," she said, referring to accommodation and travel costs paid for on trips to China.
Visibly disappointed by the recent decision of council to terminate the Chinatown contract, Cr Whitney has come under fire from some sectors of the community because with only a perceived conflict of interest she could have stayed in the room and ultimately changed the outcome with her vote.
"Eventually I did seek legal advice about whether there was a true conflict and whether I could remain in the room, however this was overshadowed by continual CCC claims, so my thinking was I stayed out from the start and that I should remain out until I had clarification and clearance," she said.
"I was doomed whether I stayed in or out but I've dealt with this with professionalism and integrity and that's the way I do business."
