Off-duty officer cops a spray
A MAN who urinated on an off-duty police officer from the passenger window of a moving car has been fined $1530.
Carl Anthony Goss appeared in the Proserpine Magistrate's Court on Monday charged with common assault, committing a public nuisance offence, failing to wear a seatbelt and travelling in a vehicle with part of his body outside the window.
The Whitsunday police officer in question was riding his bicycle home from work along Shute Harbour Road near Coral Esplanade at 6.20pm on December 6. Police prosecutor Elizabeth Smith said he was passed by a white Nissan Pulsar sedan and sprayed with liquid in the face. Ms Smith said the police officer clearly saw Goss leaning out of the window with his penis in his hand urinating. She said he immediately contacted police and gave them a detailed description.
Police soon caught up with Goss who initially told them he had been spraying water from a bottle. He then admitted his actions and was arrested and charged.
Duty lawyer Sherrie Meade said the 20-year-old plumber had been celebrating at a Christmas break-up golf day. She said Goss was picked up from Shute Harbour by his girlfriend. Ms Meade claimed Goss' friends were travelling in a car behind him and that he was looking in their direction at the time of committing the offence.
"Yes it was a very stupid thing to do Your Honour and it was very offensive to the person who was hit by that spray but it was unintentional," she said.
Ms Meade said this was now "extremely embarrassing" for Goss, who had also copped a lecture from his parents.
"Given the amount of alcohol he had dunk that day he was not using a lot of common sense," she said.
Magistrate Haydn Stjernqvist agreed Goss had displayed a "significant degree of stupidity".
"I don't believe you either when you tell Ms Meade you didn't know there was a bike rider there," he said.
"I've never heard of anything so ridiculous."
The irony of the fact that Goss' victim was a member of the police force was also not lost on Mr Stjernqvist.
"I'm speechless Mr Goss to tell you the truth and it's not often I'm speechless," he said.
For the assault and public nuisance charges Goss was fined $1200 and for the traffic offences he received a $330 fine. Convictions were not recorded.
