Offending just kept adding up

DANIEL Leech will be off the road for 12 months and has been ordered to pay $2000 in fines after pleading guilty to a string of driving and other offences in Proserpine Magistrates Court on Monday.

Police prosecutor Acting Senior Constable Tyler Roberts said Port Douglas Police were called at about 10pm on February 21, 2008, with reports a car was doing burnouts on the Captain Cook Hwy, Craiglie.

Police pursued Leech, reaching speeds of up to 130kmh, before he turned right and veered "into the oncoming lane”.

After another "skidding” turn, Leech entered a caravan park, pulled up near the main office and turned off the car's lights.

His passenger then jumped out of the car and ran into nearby bushes.

"The driver, the defendant in this matter, was slumped in the driver's seat to avoid being seen,” Snr Const Roberts said.

Leech returned a blood-alcohol reading of 0.130 and was found to be driving on a demerit-point suspended licence.

In a separate incident, Leech was intercepted at about 8.55pm on February26, 2008, on Old Port Rd, Craiglie, after officers recognised his vehicle.

The prosecution was unable to provide a breath analysis certificate, however Leech opted to accept the reading without challenge.

On March 2 of the same year, Leech once again ran foul of the law in the Port Douglas region, when a search of his home uncovered drug utensils.

Leech was ordered to complete drug diversion in Cannonvale on April 16 but failed to attend.

The latest in this string of offences occurred at about 11.45pm on July 16 this year, when Leech and his father were evicted from Magnums Hotel in Airlie Beach.

Snr Const Roberts said police arrived to find Leech and another man "pushing and shoving”.

"Police spoke with one male who stated that he was walking past when the defendant started to antagonise him,” he said.

Leech told officers he was evicted from the hotel and "as he was kicked out, the security guard called him a junkie”, to which Leech took offence.

Snr Const Roberts said Leech then began "abusing anyone in his path”.

The other man involved in the argument was cautioned by police.

"The defendant told police to (expletive) off or I'm going to fight you too,” Snr Const Roberts told the court.

Leech was then arrested.

In court on Monday, magistrate Simon Young asked Leech if there was anything he should take into account when disqualifying his licence.

"It is going to be somewhere in the order of 12to 15 months,” he said.

Leech replied he had since found employment and brought his young family up from Sydney.

"I need my licence because of my two children, but I realise I'm going to lose it,” Leech said.
