One-punch attack leaves lasting consequences

ONE-PUNCH attacker Ryan Alston Murray may have walked free from court but his violent outburst has not been without consequence.

His immediate remorse, demonstrated by loaning the victim his shirt to stem bleeding caused by the punch, went in the 20-year-old's favour when he was sentenced in Maroochydore District Court on Monday.

The court heard the two men knew each for about 18 months before the incident out the front of an Alexandra Headland house party on June 7 last year.

Murray had been removing a young woman from a car that had stopped at the front of the house party he was attending when the 21-year-old victim told him to leave her alone.

He ran at the victim and punched him to the right side of his face.

The impact caused fractures to the man's eye socket, sinus region and cheekbone.

He required surgery to insert titanium plates and screws to mend the damage.

Defence barrister Stephen Courtney said Murray had worked at Sizzler restaurant as well as for a plasterer and was effectively working seven days a week.

Mr Courtney said his client had drank three ciders on the evening of the incident but was not feeling the effects of alcohol.

He noted his client was not a large man and weighed about 60kg at the time.

"It was an unlucky punch, if I can put it that way," Mr Courtney said.

He said Murray had since unsuccessfully applied for jobs with the army as well as Ergon Energy and thought the grievous bodily harm charge would have counted against him.

Murray was also willing to pay $5160.96 restitution sought for his victim's medical expenses.

Judge John Robertson noted Murray had been grieving a young friend who had died not long before the incident.

Judge Robertson regarded the punch as a sudden reaction and noted Murray's immediate remorse.

"I'm satisfied this was a one-off event that won't be repeated," Judge Robertson said.

He ordered Murray perform 240 hours of community service and placed him on a two-year probation order.

Murray was also ordered to pay $5160.96 restitution.

A conviction was not recorded.
