Outburst seen by kids
SMASHING his fists into his children's dinner plates was the last thing expected of a Proserpine man when he and his family sat down on the couch together to eat their dinner.
Shouting that he was going to "OD” in front of his partner and two children after consuming prescription medication, beer and rum, the man then smashed the plates of his children on the evening of September 6, Proserpine Magistrate Court was told.
The man's partner sent the children to bed and saw the man take two more of his prescription medication, the court was told. She waited for him to pass out before calling police who found broken plates with food in the kitchen rubbish bin.
The man's behaviour meant he had broken two of three requirements of a good behaviour bond for breaching a domestic violence order, which had been placed on April 29, 2016, including good behaviour towards his partner and their two children. Representing himself at the court on Monday, the man admitted to smashing his own plate but denied smashing his children's.
Police prosecutor Sabine Scott said when the man had woken to find police in the house, he had become aggressive, calling his partner a "b****” and a "liar”.
Police could see the man was still intoxicated and unsteady on his feet, with cuts on his hands, the court was told.
He denied any wrongdoing, saying he received the cuts during martial arts.
He was taken to hospital in relation to the prescription drugs and told the court he had "very bad” mental health issues.
Acting Magistrate Ronald Muirhead considered the man's history and imposed a nine-month probation order.
