Public nuisance final warning

A MAGISTRATE has warned a repeat public nuisance offender he is "best not to come back” to court.

Appearing in custody at Proserpine Magistrates Court on Monday, Shane Michael John Burke pleaded guilty to two charges of public nuisance.

Police prosecutor Sergeant Sabine Scott said the first incident occurred on October 28 about 10.30am when police were called about a man near Shingley Beach who was "swearing loudly and acting bizarrely towards members of the public”.

After warning Burke to move on, police were called again about his behaviour about half an hour later, locating him near the botanical gardens.

Sgt Scott said Burke was "yelling incoherent abuse and seemed intoxicated” before he was arrested.

The second incident occurred about 9am on November 7 when police were called to the botanical gardens.

Sgt Scott said Burke was reportedly "yelling obscenities” and being aggressive to passers-by.

Police located him across from Whitsunday Police Station and warned him to move on but he continued his behaviour and was arrested and denied bail.

Burke was convicted and sentenced to eight days jail, time already served.
