Released as time served
ROSS Daniel Deacon is a free man following his release from prison after being sentenced to jail time he had already served.
Appearing via video link in Proserpine Magistrates Court on Monday, the court heard Deacon had borrowed his mother's car in December so he could move his belongings from Toowoomba to Mackay.
In January, his mother asked for her car to be returned but Deacon failed to do so.
Deacon's mother asked her other son to go to Deacon's property and check the car, but upon arrival he found the car was gone.
On January 12, Deacon was arrested for other matters and told police the car was in the hands of a friend.
Deacon's case was unable to be finalised until magistrate Simon Young had evidence the car had been returned to his mother.
Deacon was sentenced to 25 days imprisonment, time already served, for possessing explosives, possessing used drug utensils, possessing dangerous drugs and having a knife in a public place.
He then received 22 days imprisonment, time served, for obstructing a police officer. He received a $1000 fine for using a phone to harass another person.
