Serial offender gets jail, walks

A SHOCKING case of domestic violence abuse has resulted in a man being sentenced to six months' imprisonment, although he was released immediately on parole.

Proserpine Magistrates Court heard on Monday that a 33-year-old Whitsunday man had gone into a verbal tirade against his former partner on August 15.

It began in the morning around 9.30am when the partner contacted the man about an arrangement with their children.

After a disagreement he told her to "go f*** yourself".

Later that day, around 1.41pm, the man contacted his former partner and said not to worry about picking up their child and then unleashed a stream of abuse, saying "go f*** yourself c***".

Then at 4.10pm, the former partner attended the man's place of employment to retrieve their child. After putting the child in her car, the man said "you're playing with the wrong c***"and he would "f*** you up big time".

As the partner drove away, the man did a slitting throat gesture towards the former partner.

Proserpine police later arrested the man.

The man's solicitor said the disagreements had been about money and the man "did not know why the wife had come to pick up their child" and it was a "very difficult situation".

"If there's anything that can be said, there was no physical violence," the solicitor said.

Magistrate Simon Young did not hold back in his assessment of the case.

"You're setting an absolutely atrocious example for your children," he said.

"You should be ashamed. If you're trying to set an example (for your children) this is not how you go about it".

The court also heard the man was on probation and had shown to have no intention of modifying his behaviour.

A parole officer said "he's not participating" and "lacks willing engagement".

As a result he was resentenced for a total of eight domestic violence offences, including the two he was facing court for.

"Threatening to f*** up their mother and doing a slitting throat gesture doesn't get anywhere close to acceptable behaviour," Mr Young said.

"It shows that once again, by failing to commit to your probation order, you've demonstrated you have no commitment to rehabilitating behaviours.

"The luxury you seem to have for yourself about following your regimens now ends. You cannot afford to commit any further breaches of your protection order.

"You leave here today quite lucky."

The man was resentenced to two months for each of his eight previous domestic violence breaches, to be served concurrently, and a total of four months for his two new charges and released immediately on parole.

The domestic violence order was extended by 12 months.
