Smashed phone lands man probation for DV argument
SMASHING a phone on a kitchen bench in a domestic violence dispute has cost one man six months probation.
The Proserpine Magistrate's Court heard the 26-year-old was dropping his children off at a house on Shute Harbour Rd, Cannonvale, around 9.10am on June 11 when the incident occurred.
Police prosecutor Mike Ball said the man arrived at the house of his former partner and entered into a heated verbal argument with her that ended when the man smashed her phone multiple times into the kitchen bench.
Police attended the scene around 9.30am but the man had left. They were called again around 11.40am the same day when the man returned and refused to leave, leading to his arrest.
Duty lawyer Cleo Rewald said the man had arrived to find "a number of people in the house" and "drugs visible in the residence". She continued to say "he says the phone was his and it was given to her, he grabbed it and said I'm taking this phone back now".
"He's gotten frustrated and banged it on the bench and has broken it," she said.
The man's case was compounded further by his failure to appear at a previous court date because he "had his dates mixed up".
Magistrate Simon Young sentenced the man to six months probation with no conviction recorded.
