Street urination brings wee fine and community service

TAKING a relief stop on one of Toowoomba's busiest CBD corners when a police patrol is parked nearby is not the smartest thing Marcus James Politch has done.

Despite being less than 50m from the public toilets in the Neil St car park, the 26-year-old had exposed himself at the corner of Margaret and Neil Sts about 3.40am, April 8, and appeared to urinate, Toowoomba Magistrates Court was told.

When police approached and spoke to him, an obviously drunk Politch continued to drink from a can of beer on the footpath.

Arrested and charged with wilful exposure and consuming liquor on a road, he was taken to the watch house where a pat-down search found he was carrying a Stanley knife, police prosecutor Senior Constable Al Windsor said.

Politch pleaded guilty to all three charges as well as to breaching an 18-month probation order he had been subject to at the time for a charge of wilful damage.

His solicitor John Davis told the court his client had been using the Stanley knife earlier that day while working and that he had simply left it in his pocket.

Asked by Magistrate Catherine Pirie why his client hadn't used a toilet, Mr Davis said Politch was "grossly intoxicated" at the time and wouldn't have been allowed back inside a licensed venue.

"That's about as public as it can get at 3.40 in the morning," Ms Pirie said of Politch's actions.

Looking through his history, Ms Pirie noted a "common thread" to Politch's offending was gross intoxication.

Taking into account he had spent the night in custody, Ms Pirie fined Politch $300 and ordered he do 40 hours community service.
