Tortured teen bashed for hours

A YOUNG man was tied to a tree, bashed for hours and threatened with death because he wouldn't have a drink with his attackers.

John Henry Kershaw, 26, was living with the 18-year-old victim in a tent in bushland at Goodna when Kershaw and a 16-year-old boy starting drinking alcohol together.

The pair asked the victim to join in and when he refused, they launched a vicious, prolonged and torturous attack on the victim, repeatedly kicking and punching him in the face, ribs, stomach and gentiles.

Kershaw tied the victim to a tree with rope around his neck so tight the man feared for his life.

The court heard Kershaw and the youth said they "would have to kill him or he'd dob on us".

The victim pleaded with his attackers, saying "Don't kill me, I'm not worth it". Kershaw covered the victim's eyes with cloth and put a knife to his throat, and urinated on his face and head.

Kershaw eventually brought the two-hour attack to an end and called an ambulance for the victim the next day, on July 28 last year.

The court heard the victim was beaten so badly he was unrecognisable. He was treated for facial, head and abdomen swelling and bruising, a bruised brain and strangulation marks to his neck.

Kershaw pleaded guilty to assault occasioning bodily harmed in company, depravation of liberty and common assault. He was sentenced to four years in jail, with a recommended parole release date of March 12, 2013.

Defence barrister Geoffrey Seaholme spoke of Kershaw's sad, transient upbringing and said the offence was out of character.

Judge Gregory Koppenol said urinating on the victim's face was a "despicable and appalling act of contempt towards the complainant - it was totally unnecessary and unprovoked".
