Turtle owner wins court appeal

A MAN who was fined $4000 after pleading guilty to not caring for three turtles properly has won his appeal.

Robert Johnson, 69, was fined in Southport Magistrates Court in January this year for six charges relating to keeping turtles in a fish tank with dirty, green and fouled water with no filtration and no substrate eating or sunlight.

The turtles had to be euthanised.

A court judgment said Mr Johnson explained that his near blindness meant he could not properly see the turtles.

The District Court at Southport has set his $4000 fine aside and ordered he be placed on a probation order for nine months.

The district court also ordered he pay $559 in compensation in instalments.

The court also confirmed the magistrate's court order that no convictions be recorded against him.
