Whipped partner with soiled underwear

A BLACKS Beach man has been sentenced to 18 months in prison for a "deplorable" assault against his former partner and a neighbour who intervened to help her while he was on parole.

John Rex Palmer, 34, pleaded guilty to assault occasioning bodily harm, contravening a domestic violence order and common assault in the Mackay Magistrates Court on Friday.

He appeared via videolink.

The court was told that on May 4 Palmer used a pair of his partner's soiled underwear he took from her bedroom to whip her multiple times, as her young children watched on.

At one point one of them attempted to intervene. A next-door neighbour also tried to help the woman, the court was told, when Palmer then briefly brandished a kitchen knife to threaten him.

Palmer's defence lawyer Rosemary Varley told the court his partner was suffering from liver disease at the time and has since passed away.

In sentencing Palmer, magistrate Mark Nolan called his actions "appalling" and "deplorable".

"This incident involves you exposing the now deceased aggrieved to domestic violence," he said.

"The young child saw to intervene between you and the aggrieved to assist her... it must have been terrifying for this young child, something he will find very difficult to forget."

"Your conduct towards the neighbour who came to assist the children is equally as deplorable," magistrate Nolan said.

"It is disgraceful behaviour that you can do this to a person you are in a relationship with beggars belief. And to do this in front of the children is just appalling."

Palmer had been out on parole from March 29 last year after serving a sentence on burglary charges.

He was sentenced to 18 months imprisonment.

He had been remanded in custody since May 5 last year and will be eligible for parole on March 3.
